c. The Governing Body may return the recommendation to the Planning Commission for further consideration, along with a statement specifying the basis for the Governing Body's decision to return it. (1) After considering the returned recommendation, the Planning Commission may submit an amended recommendation , or may resubmit their original recommendation along with their reasons for doing so. (a) After receipt of the Governing Body's report, and following the Planning Commission's next regular meeting, the Commission must deliver its amended or resubmitted recommendation to the Governing Body. (b) If the Planning Commission fails to deliver its amended or resubmitted recommendation after its next regular meeting, the Governing Body must consider the Commission's inaction as a resubmission of the original recommendation. (2) Upon receipt of the Planning Commission's recommendation, or after the Planning Commission's inaction, the Governing Body may, by a simple majority vote, take one of the following actions: (a) Adopt the amendment. (b) Revise or amend the amendment, and then adopt it by an ordinance. (c) Take no further action on the Planning Commission's recommendation. 5. The amended Subdivision Regulations become effective upon publication of the adopting ordinance.

102 Amendment Procedure A. These Subdivision Regulations may be amended at any time. 1. The Planning Commission must hold a public hearing on the proposed amendment. a. The hearing may be adjourned from time to time. 2. A notice of the public hearing must be published once in the official city newspaper, at least 20 days before the date of the hearing. a. The notice must provide a general description of the proposed amendment, and state the time and place for the hearing. 3. At the conclusion of the public hearing, the Planning Commission must submit its recommendation on the proposed amendment to the Governing Body. a. A written summary of the hearing must also be presented to the Governing Body. b. Adoption of a proposed amendment requires an affirmative vote of a majority of the Planning Commission's entire membership. 4. The Governing Body may approve the amendment to the Subdivision Regulations, override it, or return it to the Planning Commission. a. The Governing Body may approve the amendment by ordinance. b. The Governing Body may override the Planning Commission's recommendation by a 2/3 majority vote.
