CHILD CARE FACILITY: A place operated by a person, society, agency, corporation, institution, or any other group that is licensed or registered by the state to provide regular shelter, care, activity, and supervision for children less than 16 years old. 1. Child care facilities regulated by the Kansas Department of Health and Environment include boarding homes for children and youth, child care centers, preschools, day care homes, group day care homes, and family day care homes. 2. Child care facilities regulated by the Department for Children and Families include family foster homes, group boarding homes, and residential centers. 3. See Zoning Regulations, Section 4-100 for detailed definitions of each type of Child Care Facility. COHESIVENESS: Unity of composition, among design elements of a building or a group of buildings, and between buildings and their associated landscape. COLLECTOR STREET: See STREET/COLLECTOR STREET. COMMERCIAL MOTOR VEHICLE: A motor vehicle designed or used to transport passengers or goods, if: 1. The vehicle has a gross vehicle weight rating of 26,001 pounds or more, or a lesser rating which is not more restrictive than the federal regulation. 2. The vehicle is designed to transport 16 or more passengers, including the driver.
COMMON OPEN SPACE: A parcel of land which is designed and intended solely for the shared use and enjoyment of the residents of an associated subdivision or development. Common open space may include bodies of water, and recreational facilities such as a clubhouse, swimming pools, paths or fishing docks. 1. Common open space does not include streets, alleys, parking or loading areas, public parks or open space, or other facilities dedicated by the developer for public use . COMPATIBILITY: Harmony in the appearance of two or more
external design features in the same vicinity. CONDITIONAL USE: See USE, CONDITIONAL.
CONDOMINIUM: A multiple-unit building or development, utilizing a form of property ownership which provides for individual ownership of a unit, together with an individual interest in the land or other parts of the structure which are held in common with other unit owners. (See K.S.A. 58-3102.)
3. The vehicle is transporting hazardous materials, and is required to be placarded in accordance with 49 C.F.R. § 172, subpart F.
