2. The following development activities do not require Site Plan Approval. a. Routine maintenance, such as new roofing, or painting which does not change the primary color of the building. b. Replacing an existing approved sign with one that has the same size, location, and lighting as the existing sign. (1) Exception: After the time limit for legally nonconforming signs passes, any replacement signs must comply with Zoning Regulation requirements in effect at that time. (See Zoning Regulations, Section 8-109B on Amortization of Nonconforming Signs.) (2) Exception: If a damaged or unsafe sign or sign structure is replaced, it must conform to Zoning Regulations current at the time of replacement. (See Zoning Regulations, Section 8-108G on Dangerous Signs.) 3. In the MXN zoning district , Site Plan Review Standards will be applied to projects on a case by case basis. D. Site Plan Approval Procedures and Review Standards. 1. The Site Plan Review Committee must prepare procedures for the submittal of site plans for review, and standards for their approval. a. Proposed procedures and standards must be submitted to the Planning Commission for review. The Planning Commission must make a recommendation to the Governing Body. The Governing Body must approve the procedures and standards before they are implemented. b. A mendments. Any amendments to procedures and standards must be reviewed and approved in the same manner. c. Site Plan Approval application submittal procedures and review standards are available in Part 3 of the Andover Unified Development Manual.

4. All meetings must be open to the public and held in accordance with Kansas law. (See K.S.A. 75-4317 et seq. and Kansas Open Meetings Act, Guidelines for Committee Use.) a. Before each Committee meeting, an agenda must be published in the official City newspaper, identifying the site plans to be reviewed. 5. At least 4 members of the Site Plan Review Committee must be present to hold a meeting. a. Approval or disapproval of an application must be decided by an affirmative vote of the majority of the members present. b. A minimum of 3 affirmative votes are required for approval or disapproval. C. Applicability. Site Plan Review is limited to the specific change being made in the building or site. For example, if the building is being re-sided, only the appearance of the siding is reviewed. 1. The following development activities require Site Plan Approval. a. Nonresidential projects, including exterior remodeling of existing nonresidential properties. b. Apartments and multiple-family dwellings in a courtyard or grouped setting. c. Nonresidential screening and landscaping projects adjacent to an arterial street. d. New parking lots and additions to parking lots , except for those accessory to single-family dwellings and townhouses. e. Painting which changes the base primary color of the building.
