RESTAURANT: A commercial establishment principally used for the preparation and sale of food and beverages, which may be consumed either on or off the premises. 1. Restaurants which incorporate a DRIVE-IN ESTABLISHMENT or include DRIVE-THROUGH FACILITIES may be permitted as a conditional use in some zoning districts. a. Restaurants which provide liquor by the drink must not include a drive-in establishment or drive-through facility. 2. To be a restaurant, as opposed to a DRINKING ESTABLISHMENT, sale of food consumed on the premises must constitute at least 50% of the gross annual sales receipts for food and beverages combined. 3. See K.S.A. 41-2642 for licensure and regulation of sale of liquor by the drink, and K.S.A. 41-2601 for definitions. RESTRICTIVE COVENANTS: Contracts among private parties which place restrictions on the use of private property within a subdivision, intended to provide mutual protection for property owners against undesirable aspects of development which might compromise property values. 1. Restrictive covenants may be included in a deed, and usually run with the land. They are also placed of record by separate instruments, including homeowner association agreements. RETAIL: Selling of goods or merchandise to the ultimate consumer for direct consumption or use, and not for resale. 1. Auctions are not considered retail sales. RETENTION POND: POND, RETENTION. REVERSE FRONTAGE LOT: See LOT/REVERSE FRONTAGE LOT.

RIGHT-OF-WAY : A publicly owned strip of land, dedicated to public use and under the control of a public agency, intended to accommodate vehicle and pedestrian transportation systems and utility infrastructure. (See K.S.A. 17-1902.) 1. A right-of-way is not an EASEMENT. 2. A public right-of-way for a street typically includes both the roadway (including curbs and gutters), PARKING STRIPS on either side, and any adjacent sidewalks.
