USE, PERMITTED: A use of a structure or land which is permitted outright within a zoning district, because it is suited to the designated purposes of that zone. (See Zoning Regulations, Section 5-102 through 120.) USE, PRINCIPAL: The main use of land or structures, as distinguished from a subordinate or accessory use. USE, SPECIAL: A use of a structure or land which is not permitted outright within a zoning district, because of characteristics that might have an adverse affect on nearby properties or the future development of the district, unless certain conditions can be placed on the use which would make it suitable to the purpose of the district and compatible with other designated uses. (See Zoning Regulations, Section 12-101 for Special Uses.) 1. Such uses are "special" in that they are often large, one-of-a-kind, private or public uses serving as community facilities, or uses whose location would have planning implications for a neighborhood or the entire City. 2. Designated special uses are processed in the same manner as zoning amendments, except that they are not shown on the Official Zoning Map, a particular use is applied for within a district, and conditions may be recommended by the Planning Commission and attached to their approval by the Governing Body. USE, TEMPORARY: A use established for a fixed period of time, in a zoning district where such a use would otherwise not be permitted. (See Zoning Regulations, Section 7-102 for Temporary Uses.)

USE REGULATIONS: The provisions of these regulations which: 1. Identify permitted, special and conditional uses. 2. Impose use limitations. 3. Regulate accessory and temporary uses. 4. Regulate home occupations. UTILITARIAN STRUCTURE: A structure or enclosure relating to the mechanical or electrical services for a building or development. UTILITY HARDWARE: Devises used for water, gas, oil, sewer, electrical, and communications services to a building or a project, such as poles, cross arms, transformers, vaults, gas pressure regulating assemblies, hydrants, transmitters or antennas. UTILITY SERVICE: Any device which carries gas, water, electricity, communications, or mechanical services to a building or development, including wire, pipe, and conduit. VACATION PETITION: A method used to initiate the vacation of streets, alleys, easements, other public reserves and plats. (See Subdivision Regulations, Section 11-102-A1 for vacation petition.) VARIANCE: A modification of certain provisions of the zoning requirements for a specific parcel, which does not change the parcel's zoning, and is granted only where strict application of zoning requirements would result in unnecessary hardship, and when the variance is not contrary to the public interest. (See Zoning Regulations, Section 11-106 on Variances.) 1. A variance may be granted regarding lot area, bulk regulations, permitted obstructions, parking requirements, sign provisions, floodplain requirements and the like, but must not be granted for underlying use .
