K. Enforcement. The Zoning Administrator must enforce the Site Plan Review provisions of these Zoning Regulations, in consultation with the City Attorney. 1. All work shown on the Site Plan Approval application documents must be inspected and approved by the Zoning Administrator or their designated representative, or the City may withhold issuance of any zoning permit, building permit, occupancy certificate, or inspection required under the current City Zoning Regulations or Building Code, or the City may issue cease and desist orders for further development. L. Fees. The Applicant must pay the City Clerk a fee, as determined in the fee schedule approved by the Governing Body, when applying for site plan review and approval. 1. Fees associated with site plan review and approval are intended to help defray the costs of administration and enforcement. 2. Fees are not refundable. 3. See Chapter 1.2.2 for current Fees.
3. If the property owner does not make the necessary maintenance improvements by the date specified for compliance by the notice or by the Board of Zoning Appeals, the Zoning Administrator must cause the maintenance to be done. a. The Zoning Administrator must certify the cost of maintenance to the City Clerk. b. The City Clerk must assess the cost against the property on which the necessary maintenance improvements were made. J. Appeals. 1. Where Site Plan Approval has been conducted by the Zoning Administrator , decisions of the Zoning Administrator may be appealed to the Site Plan Review Committee for reconsideration. 2. Where Site Plan Approval has been conducted by the Site Plan Review Committee , decisions of the Site Plan Review Committee may be appealed to the City Board of Zoning Appeals. a. An application for appeal to the City Board of Zoning Appeals must be submitted within 30 days after the Site Plan Review Committee decision . b. The Board of Zoning Appeals will consider the appeal, and make a determination based on the reasonableness of conditions attached to the issuance of the Applicant's zoning permit. c. A Site Plan Approval application may be approved by either the Site Plan Review Committee or the Board of Zoning Appeals.
