B. Zoning. A WECS which meets the zoning district's maximum height requirements is a permitted use in every zoning district. A WECS which exceeds the zoning district's maximum height may be considered as a special use in that zoning district. 1. A plot plan must be submitted with the application for a zoning permit showing the proposed location and dimensions of the WECS, guy wires or other support, fencing and all existing buildings within 50 feet of the property line. 2. The WECS owner is responsible for the costs of required engineering certification. 3. Inoperable or Nonconforming WECS. Any WECS which becomes inoperable or fails to conform to these Zoning Regulations must be shut down, repaired, or removed within 60 days . a. Public Safety. If a WECS is inoperable or fails to conform to Zoning Regulations because of a condition which could effect public safety, then the WECS must be removed from operation as soon as the condition is apparent or made known to the owner. (1) The owner must secure the inoperable WECS so as to protect public safety. C. Minimum setback distance from all lot lines must equal the total height of the WECS. D. Design Guidelines. Zoning permit approval for a WECS is based on the following design guidelines. When applied as conditions attached to the permit or the premises, design guidelines may be modified to be more or less stringent depending on the location and the relative need to avoid injurious effect. 1. Tower Design. a. The WECS tower must be designed to meet City Building Code requirements. The design must be certified by a licensed engineer registered in Kansas.
(1) Meet Code structural requirements, and ensure the structural integrity of tower installation. (2) Meet Code wind and seismic requirements. b. Limit climbing access to a WECS tower. (1) If a tower ladder is installed, it must have no steps within 8 feet of grade. (2) If a tower ladder is installed, it must be enclosed with a fence at least 6 feet high, with a lockable gate. 2. Noise and Interference. a. Noise. In any residential zone, noise levels measured at the WECS zoning lot line must not exceed 60 decibels. (1) Measure decibels as per Article 9, Chapter IV of the Code of the City of Andover, Kansas. b. Interference. The WECS must not cause interference to microwave communications or radio and television reception in the area. 3. Electrical Components. a. All electrical components of the WECS and its support system must comply with the City Building Code and good engineering practices. (1) Compliance with regulations must be reviewed and certified by a licensed engineer registered in Kansas. b. The electrical box and any other hazardous components within reach of a person on the ground must be secured to prevent unauthorized entry. 4. Controls. The WECS must be equipped with both manual and automatic controls, to limit the rotational speed of the blade below the design limits of the rotor. a. A licensed engineer registered in Kansas must certify
that the rotor and overspeed controls have been designed and fabricated for the proposed use in accordance with good engineering practices.
