The COA said that the requirement to bring a claim within three months of every occasion where the claimant is not paid for leave is incompatible with the principle of effectiveness. The principle of effectiveness requires that claims based on EU law should not be subject to rules or procedures that make them impossible to practice or excessively difficult to enforce.

This is a significant decision which emphasises the importance of providing employees and workers with the correct holiday entitlement and payment. Employers who fail to do so risk adding significant court costs to their holiday pay bill.

18 February is National Caregivers Day 18 February 2022

The third Friday in February marks National Caregivers Day, and this year, that falls on 18 February 2022. The day celebrates those individuals who provide personal, physical and emotional support to those who need it. There are several types of caregivers, and the day is used to recognise and appreciate them all. The government confirmed, in its consultation response on the topic of introducing carer’s leave, that a new day one employment right would be made available. This would allow eligible carers to take a week’s worth of unpaid leave, to care for a ‘dependent’ who has a ‘long - term care need’.

The right will be introduced as soon as Parliamentary time allows, but those who provide care and employers of carers should be aware of the new employment right that will be coming in.

The week of leave can be taken flexibly, for example, in half days, full days or in a single block of one week. This is so that it can be of real benefit to individuals who have caring responsibilities.
