case the overpack cars and train) would transverse the railroad route without any impediment. It would need to be resubmitted after 6 months to ensure no changes have taken place on the rail route that would affect the ability for the dimensional load to pass the route safely without striking anything (tunnels, bridges, trestles, signals, silos, or any structure that may be close to the track), including taking into consideration passing dimensional traffic. Note: The railroad clearance is valid for only 6 months and must be resubmitted if shipping campaigns extend beyond that time period. NRC approvals for rail routes are granted for a longer period of time (5 years). Road permits would be required for movement of the cranes, empty casks, and other equipment to the BRP site for the overpack transfer. This would include private escorts and State Police escorts for both the mobilization and demobilization efforts. Package Permits / Requirements To transport SNF and GTCC LLW from the BRP ISFSI site, the package must meet several regulatory requirements. Those requirements are described in 10CFR71. In addition to the NRC requirements, the NRC mandates radioactive material shipments by licensees to also comply with the DOT’s safety regulations for transporting HAZMAT commodities. The DOT requirements that govern these shipments include: 49CFR Parts 107, 171 through 180, and 390 through 397, as appropriate to the mode of transport. The NRC and the DOT have an interagency agreement to work together and oversee specific elements of the transportation of radioactive materials as follows [38] . DOT:  Regulates shippers of HAZMAT, including radioactive material, and  Oversees vehicle safety, routing, shipping papers, emergency response and shipper training requirements. NRC:  Regulates users of radioactive material in 13 states (37 states regulate radioactive material users within their borders),  Approves the design, fabrication, use and maintenance of shipping containers for the most hazardous radioactive materials, including SNF, and  Regulates the physical protection of commercial spent fuel in transit against malicious acts. The NRC requires radioactive materials shipments to comply with DOT’s safety regulations for transporting HAZMAT. The NRC regulations in 10CFR71 require shipping packages, under both normal and accident conditions of transport, to:

 Prevent the loss of radioactive contents,  Provide shielding and heat dissipation, and  Prevent nuclear criticality (a self-sustaining nuclear chain reaction).
