f. If shipments are contemplated using protocols other than those agreed to for TRU waste shipments to WIPP negotiations will be held with affected states and tribes prior to the commencement of shipments. 8.2.3 Other DOE Shipments. No shipment-specific notifications, unless explicitly required, will be provided for shipments of— c. LLW and MLLW, d. isotopes, and e. tritium-bearing reactor components. 8.2.4 Additional Shipment Information Practices. DOE organizations may provide additional planning information and shipment pre-notification to State, Tribal, and local authorities. 8.3 Classified National Security Shipments Classified national security shipments that meet safeguards and security requirements, including Naval spent fuel shipments, do not provide shipment prenotifications. The Atomic Energy Act of 1954 provides security requirements for the protection of information related to nuclear weapons and special nuclear materials shipments. The DOT exemption for national security shipments is stated in 49 CFR 173.7(b).
