8.9 Development of Security Plan and Protocols for Marine Facilities The following will be considered in the development of a Security Plan and associated protocols for a marine facility site (BRP site). When a site is located on water or adjacent to water, the MTSA will be in effect and observed: If any operation is located on or adjacent to a U.S. waterway, even if it is not a port facility, an MTSA will be established for the facility and approved and enforced by the USCG as if it were a port facility. All personnel entering the marine facility will be required to secure TWIC issued by the TSA and observe the marine facility security requirements. This will apply to all employees, agents, and vendors involved in the operation of the rail transload facilities. This includes the train crew, truck drivers, and crane and transload crews. The RSAT will conduct a security assessment up to the entrance of the marine facility. A review of the Security Plan in effect inside the marine facility will be conducted with the permission of the USCG COTP. The COTP will be a member of the Administrative Team. The MTSA must be submitted and approved by the USCG. The USCG may elect to establish a Safety Zone around the facility barring any water traffic from the site while loading operations are occurring. The USCG has the authority to establish Safety Zones, which prohibit persons and vessels from transiting through, anchoring in, or remaining within the designated Safety Zone. Persons found in violation of a Safety Zone are subject to both criminal and civil penalties. All parties involved in the operations at the water-served facility must be aware of and conduct themselves in accordance with the MTSA. The Administrative Team will develop and approve all distribution lists and approved contacts. 8.10 Railroad Security Requirements The following are railroad security-related requirements: On November 26, 2008, the TSA published new rules regarding the rail transportation of certain HAZMAT, which became effective on December 26, 2008 (“The New Rules”) [43] . The materials subject to these New Rules include explosive, TIH, PIH, and highway route controlled quantities of radioactive materials of radioactive materials. TSA refers to these commodities collectively as Rail Security-Sensitive Materials (RSSM). As a result of these rules, the carrier will only be able to accept or deliver RSSM from Rail Secure Areas. There are additional requirements for delivery/acceptance of RSSM in designated High Threat Urban Areas (HTUA), but none of the geographical locations involved in this project fall into designated HTUA. Shipments of RSSM will be subject to chain-of-custody requirements which apply:
