Section 180(c) was added to the Nuclear Waste Policy Act in the 1987 Amendments Act:

“The Secretary shall provide technical assistance and funds to States for training for public safety officials of appropriate units of local government and Indian tribes through whose jurisdiction the Secretary plans to transport spent nuclear fuel or high-level radioactive waste under subtitle A [permanent repository] or under subtitle C [interim storage facility]. Training shall cover procedures required for safe routine transportation of these materials, as well as procedures for dealing with emergency response situations. The Waste Fund shall be the source of funds for work carried out under this subsection.” PHASE 1 (1990 S ) DOE’s Office of Civilian Radioactive Waste Management (OCRWM) published a strategy document, options paper, a Notice of Inquiry in the Federal Register (Vol. 60, No. 1, 99-100, January 3, 1995), and a supplement to the NOI (Vol. 60, No. 137, pp. 36793-36804, July 18, 1995). OCRWM held discussions with the states and tribes during semi-annual meetings of the Transportation External Coordination Working Group (TEC/WG), the predecessor of the National Transportation Stakeholders Forum (NTSF). In 1996-1998, OCRWM published a proposed policy and procedures and two revisions (Vol. 61, No. 96, 24772-24783, May 16, 1996; Vol. 62, No. 137, 38272-38285, July 18, 1997; Vol. 63, No. 83, 23753-23766, April 30, 1998). The key themes in the notices were “flexibility,” applicant choice, and OCRWM’s desire to “assist states and tribes to obtain access to the increment of training necessary to prepare for NWPA shipments.” The 1998 revised notice contained the following eight elements: o The revised policy did not include a list of allowable activities. o “For the most part, it would be the grantee’s decision in consultation with local governments and first responders along the routes to select who gets trained and the organization that administers the training.” o Equipment purchases were limited to 25 percent of the funds awarded in the years prior to the start of shipments, dropping to 10 percent in the year shipments would begin through that jurisdiction. Equipment must be for training-related purposes, although it could also be used for responding to emergencies or inspections. • Allowable activities: DOE has developed its policy and procedures on Section 180(c) implementation in three phases.
