According to NUREG-0561, Rev. 2, armed escorts may be members of a local law enforcement agency (LLEA). For rail shipments, at least one of the two armed escorts must be “stationed at a location on the train that will permit observation of the shipment car while in motion” (see 10 CFR 73.37(d) or p. 25 of NUREG-0561). For waterborne shipments, while docked, the shipment vessel must have two armed escorts OR one member of an LLEA either on board or on the dock. 10 CFR 73.37(c)(6) requires licensees to ensure that shipments are continuously and actively monitored by a telemetric position monitoring system or an alternative tracking system reporting to a movement control center. DOE’s TRANSCOM system is an example of such a system. States may request the sharing of positional information as part of preplanning and coordination. 49 CFR 172.820(c) Rail transportation route analysis . For each calendar year, a rail carrier must analyze the safety and security risks for the transportation route(s), identified in the commodity data collected as required by paragraph (b) of this section. The route analysis must be in writing and include the factors contained in Appendix D to this part, as applicable. … (2) In performing the analysis required by this paragraph, the rail carrier must seek relevant information from state, local, and tribal officials , as appropriate, regarding security risks to high-consequence targets along or in proximity to the route(s) utilized. If a rail carrier is unable to acquire relevant information from state, local, or tribal officials, then it must document that in its analysis. 49 CFR 385.415(b)(1) Inspection of vehicle transporting Class 7 (radioactive) materials . Before a motor carrier may transport a highway route controlled quantity of a Class 7 (radioactive) material, the motor carrier must have a pre-trip inspection performed on each motor vehicle to be used to transport a highway route controlled quantity of a Class 7 (radioactive) material, in accordance with the requirements of the “North American Standard Out-of-Service Criteria and Level VI Inspection Procedures and Out-of-Service Criteria for Commercial Highway Vehicles Transporting Transuranics and Highway Route Controlled Quantities of Radioactive Materials as defined in 49 CFR Part 173.403”, (incorporated by reference, see §385.4). 49 CFR 397.101 Requirements for motor carriers and drivers . (a) Except as provided in paragraph (b) of this section or in circumstances when there is only one practicable highway route available, considering operating necessity and safety, a carrier or any person operating a motor vehicle that contains a Class 7 (radioactive) material, as defined in 49 CFR 172.403, for which placarding is required under 49 CFR part 172 shall:
(1) Ensure that the motor vehicle is operated on routes that minimize radiological risk ;
(2) Consider available information on accident rates, transit time, population density and activities, and the time of day and the day of week during which transportation will occur to determine the level of radiological risk; and
(3) Tell the driver which route to take and that the motor vehicle contains Class 7 (radioactive) materials.
(b) Except as otherwise permitted in this paragraph and in paragraph (f) of this section, a carrier or any person operating a motor vehicle containing a highway route controlled quantity of Class 7 (radioactive) materials, as defined in 49 CFR 173.403, shall operate the motor vehicle only over preferred routes . (1) For purposes of this subpart, a preferred route is an Interstate System highway for which an alternative route is not designated by a State routing agency; a State-designated route selected by a State routing agency pursuant to § 397.103; or both of the above. (2) The motor carrier or the person operating a motor vehicle containing a highway route controlled quantity of Class 7 (radioactive) materials, as defined in 49 CFR 173.403, shall select routes to reduce time in transit over the preferred route segment of the trip. An Interstate System bypass or Interstate System beltway around a city, when available, shall be used in place of a preferred route through a city, unless a State routing agency has designated an alternative route .
