Statutory/Regulatory Authorities…How They Help Manage Conflict: • Tribal Gaming Ordinance: Mandates express and implied duties of the TGRA. • IGRA: Establishes non-negotiable federal statutory requirements. • NIGC Regulations: Compliance with which is mandated under IGRA. • Tribal State Compact: Sets forth requirements to which the Tribe has agreed through formal government-to-government contract. • Tribal Internal Control Standards: TGRA authorized by the Ordinance to develop regulations; also required by the NIGC MICS. • TGRA’s Internal Policies and Procedures: Shows that the TGRA doesn’t just “wing it” and make it up as it goes along.
Always Consider… As a Regulatory Official you hold a vital position of authority. The Tribe’s system of regulation depends upon the TGRA exercising appropriate authority as needed in order to uphold the mandates of the Ordinance. But authority must be exercised with prudence and proportionality.
