PROGRAM COMPLIANCE
Regulations & Monitoring: SBCSS State Preschool program conforms to the laws and regulations in Title 5 Education Code monitored by the California Department of Education, Early Education and Support Division. We also adhere to Title 22, Child Care Center and General Licensing regulated by the California Department of Social Services Community Care Licensing. These regulations include staffing standards and ratios for the program. These standards are designed to assure the basic health and safety of the children in the absence of their parents. The Community Care Licensing office assigns Licensing Program Analysts to monitor and visit the preschool classroom for compliance with the regulations. The Department has the inspection authority specified in Health and Safety Code Sections 1596.853 and 1596.8535 Health and Safety Code Section 1596.852 provides: • Any duly authorized officer, employee, or agent of the department may, upon presentation of proper identification, enter and inspect any place providing personal care, supervision, and services at any time, with or without advance notice, to secure compliance with, or to prevent a violation of, this act or the regulations adopted by the department pursuant to the act. Health and Safety Code Section 1596-8535 provides: • The department has the authority to interview children or staff without prior consent. • The licensee shall insure those provisions are made for private interviews with any children or staff member. • The department has the authority, audit, and copy child or childcare center records upon demand during normal business hours. Records may be removed if necessary for copying. • The license shall ensure that provisions are made for the examination of all records relating to the operation of the childcare center. • The department has the authority to observe the physical condition of the child(ren), including conditions that could indicate abuse, neglect, or inappropriate placement.
