STILL HAVE QUESTIONS AFTER AN INJURY? This Month’s Most Common Legal Questions, Answered!
MALLOY LAW OFFICES, LLC
Last month, I shared answers to some of the most frequently asked personal injury questions I get from clients. The response was incredible! Personal injury cases can feel overwhelming. Between doctor visits, calls from insurance adjusters, and trying to make sense of your rights, it’s a lot. This month, I’m back with a fresh batch of five questions that keep popping up. Let’s clear up the confusion. 1. ‘What if I didn’t go to the hospital right after my accident? Can I still file a claim?’ Yes, you can. But here’s the catch: The insurance company will likely try to use the delay in treatment against you. They’ll argue you weren’t seriously injured or that your injuries weren’t caused by the accident. That’s why seeking medical care as soon as possible is crucial, even if you feel “fine.” Some injuries, like whiplash or soft tissue damage, don’t immediately show symptoms. The sooner you document it, the better.
available options, especially if other parties (like a vehicle manufacturer or employer) might share liability. 3. ‘Can I get compensation if my injury made a preexisting condition worse?’ Absolutely. The law recognizes what’s called the “eggshell plaintiff” rule. It means the at-fault party is still liable for injuries they caused, even if your body was vulnerable due to a prior condition. If a back injury from the accident aggravated an old surgery site or chronic pain, you may still be entitled to damages. The key is showing how the accident worsened your condition, which often requires solid medical documentation. “Every injury case is different, but one thing’s always true: Knowledge is power.” 4. ‘Will posting on social media hurt my personal injury case?’ It can and often does. Insurance companies and defense attorneys monitor social media closely. That photo of you smiling at a friend’s barbecue or a status update saying, “Feeling better today!” could be twisted and used to downplay your injuries. The safest move is to stay off social media or make your profiles private and avoid posting about your accident, health, or activities.

2. ‘The other driver doesn’t have insurance. What now?’
If the person who hit you is uninsured or underinsured, don’t panic just yet. You may be able to file a claim through your auto policy if it includes uninsured motorist coverage (UM or UIM). This coverage is a safety net in situations like this. A personal injury attorney can help you explore all

‘YES DAY’ MAGIC
Let Your Kids Run the Show (With a Few Rules!)
Imagine a day when your kids get to call the shots. Ice cream for breakfast? Sure. Pajamas all day? Why not. That’s the magic of a “Yes Day” — a full 24 hours where the answer to (almost) every request is a “YES!” It’s a chance to say goodbye to the daily “No, no, no!” and “Maybe later” and embrace spontaneity, laughter, and connection. But let’s be real: Without a few guidelines, a Yes Day would spiral into pure chaos. That’s why setting a few ground rules ahead of time can turn this fun tradition into a memory-making success for everyone.
Day boundaries — they keep things fun and manageable. Common ones include:
parents, whether it’s building a fort, going to the park, or baking cookies together.
Keep it simple and satisfying. A successful Yes Day doesn’t have to break the bank or wear everyone out. The joy comes from the freedom to choose and the feeling of being heard. You can cap the day with a movie marathon, a backyard campout, or letting your kids pick dinner (yes, even if it’s cereal and snacks). Make it a tradition. Yes Days are more than a treat; they’re a relationship builder. When kids feel seen and empowered, it deepens trust and creates moments you’ll all remember.
• • •
The requests must be safe.
Everything must stay within budget. All activities need to happen locally (or within a certain radius). Everyone has to participate (no solo fun unless it’s reasonable).
•
This sets the tone for creative, collaborative planning while avoiding unreasonable asks like “Let’s fly to Paris!” Let the kids take the lead. One of the best parts of a Yes Day is watching your kids light up as they brainstorm what they want to do. Encourage them to write down a list of ideas in advance. You might be surprised — many kids don’t ask for wild, expensive things. They just want uninterrupted time with their
Start with clear guidelines.
Before the big day, sit down as a family and lay out the ground rules. Think of them as your Yes
So, go ahead! Pick a day, set some ground rules, and get ready to say “yes” to the joy that only comes when you let go.
Most people shopping for a car think about horsepower, gas mileage, and maybe Bluetooth connectivity, not how difficult that car might be to insure. But believe it or not, your choice of vehicle can make a huge difference in your insurance costs and coverage availability. Some cars are flashy and fun but come with serious insurance headaches. So, what kinds of vehicles do insurance companies tend to avoid, or at least charge a hefty premium to cover? Let’s break it down.
DREAM CAR, NIGHTMARE INSURANCE? EVERYTHING YOU NEED TO KNOW
What Makes a Car Difficult to Insure? Insurance companies look at two big things: risk and repair or replacement costs.
• Risk includes how likely the car is to be involved in an accident or stolen. • Repair cost depends on how expensive and complex it is to fix the car.
When you include limited parts availability, specialty labor, or a bad track record among drivers, you have a recipe for sky-high premiums or flat-out denials of coverage.
Vehicles That Raise Red Flags for Insurers Exotic and Luxury Cars Think Lamborghini, McLaren, or even high-end Mercedes models. They’re fast, expensive, and attract attention, including the wrong kind. Repairs are costly, and the parts aren’t exactly at your local auto shop.
Modified or Custom Vehicles Do you love your custom paint job, lifted suspension, or aftermarket turbo kit? Your insurance company might not. Customizations can affect safety ratings and make claims more complex.

EMBRACE AUTUMN THE OLD-FASHIONED WAY Try These Rustic and Cozy Hobbies
Bake like a grandma. Fall and baking go hand in hand. Instead of scrolling for trendy recipes, try pulling out an old family cookbook —
or better yet, Grandma’s handwritten recipe cards. From flaky apple pies to buttery shortbread, baking the old-fashioned way fills your home with delicious aromas and memories to cherish. Get lost in letter writing. Snail mail might be considered a relic, but there’s something satisfying about sending — and receiving — a handwritten letter. As the pace of life slows with the season, take time to write to a loved one. Share your thoughts, your gratitude, or just say hello. It’s a small gesture that carries a ton of meaning. Forage and craft with nature. Channel your inner homesteader and get outdoors. Fall is a beautiful time to collect colorful leaves, pinecones, or acorns for crafting. Whether you create a rustic wreath, press leaves, or show off your finds in a bowl, nature-based decor is grounding and beautiful. Try your hand at canning. What about preserving a bit of fall flavor for winter? Not only is it rewarding, but you also engage in a useful practice. Canning applesauce, jams, or pickled veggies brings an old-world skill back to life and leaves you with shelves full of delicious, homemade canned goods — yum!
Fall is magical — the crisp air, changing leaves, and shorter days practically beg us to slow down. While modern life is often a blur of screens and schedules, autumn offers the perfect excuse to unplug and reconnect with simple pleasures. This fall, why not embrace a few old-fashioned hobbies that bring warmth, creativity, and nostalgia to your routine? Cozy up with hand stitching or embroidery. Nothing feels as soothing as stitching by a cozy window with a cup of tea nearby. Embroidery, cross-stitch, or simple hand-mending can be therapeutic and productive. Whether embellishing tea towels or repairing a sweater, hand-stitching is a calming and purposeful way to unwind.

Commercial or Specialty Vehicles Flatbed trucks, cargo vans, and 12-passenger vans are often considered commercial-use vehicles, even if you use them personally. Insuring them may require specialty policies. Imported or ‘Grey Market’ Cars Vehicles imported from overseas (like Japanese Domestic Market cars) that weren’t built for U.S. roads can be a tough sell for insurers. Safety features and part availability may not meet U.S. standards.
5. ‘How long does it take to settle a personal injury case?’ It depends on the case’s complexity, the severity of your injuries, and whether the insurance company plays fair. Some cases settle in a few months, while others take a year or longer. If you’re still undergoing treatment, your lawyer may wait until you reach maximum medical improvement before settling, to ensure your future medical needs are included in the claim. Quick settlements aren’t always in your best interest, and patience can lead to a better payout. Every injury case is different, but one thing’s always true: Knowledge is power. These questions come from real people trying to make sense of a confusing, stressful situation. And you deserve clear, honest answers, without legalese. If you’re injured and wondering what your next step should be, don’t guess. A quick consultation can help you understand your rights and avoid costly mistakes, and a quick consultation could make all the difference in protecting your future. Give us a call today!
Electric and Autonomous Vehicles Yes, even the much-hyped Tesla Cybertruck falls into this category. New tech equals high repair costs, and insurers still gather data on long‑term risks.
If your dream car happens to be one that insurance companies shy away from, don’t give up! Larger, mainstream insurance companies might say no, but specialty insurers may say yes. You’ll likely pay more, but you can still get the coverage you need with research and the right provider.
