Drug & Alcohol Policy - Continued

A Team Member who is required to submit to a reasonable suspicion or post-accident test will be suspended after the completion of the drug and/or alcohol tests, pending receipt of the test results. The Company also reserves the right to evaluate the Team Member’s conduct that triggered the drug and/or alcohol test, to determine if the conduct in and of itself warrants discipline, up to and including termination. Current Team Members who test positive for drugs and/or alcohol will be terminated, to the extent consistent with applicable federal, state or local laws. These Team Members will also be ineligible for employment with the Company for a period of 60 days. Upon re-hiring, these Team Members will be subject to pre-employment screening for illegal substances and/or alcohol, including marijuana. A Team Member who refuses to submit to drug or alcohol testing may be suspended from duty without pay pending further investigation and may be subject to disciplinary action, up to and including termination. Failing to cooperate fully when asked to submit to a drug and/or alcohol test and tampering with or providing a diluted specimen are also violations of this Policy and grounds for disciplinary action, up to and including termination. An applicant who provides a drug screen sample with a positive result for any illegal substance other than marijuana, will be ineligible for employment with the Company for a period of 60 days. For Maryland Team Members Only: If a Team Member or applicant tests positive for drugs or alcohol, except for marijuana, the following will occur: the Team Member will be provided with a copy of the test results, along with another copy of this policy, and a statement or a copy of the state Health Department’s regulations permitting applicants and Team Members to request independent testing of the same sample to verify the confirmed positive result. Notice of the results will be provided with in person or via certified mail no later than 30 days post-testing. The Team Member may request a confirmatory re-test of the original specimen at a different laboratory at their own expense. Such a request must be made within 72 hours of the time that the Team Member or applicant is notified that he/she has tested positive.

In Maryland, alcohol testing will be conducted by blood testing which will include confirmation testing and review by a medical review officer.

To the extent any federal, state or local law prohibits or restricts the type of testing or the circumstances in which testing can be performed and/or used, the Company will enforce its policy in compliance with such law.

27 No policy should be construed to confer any express or implied contractual relationship or rights to any Team Member. The Company reserves the right to modify any policy as necessary, in its sole discretion, to the extent permitted by law. Violation of any Company policies or procedures can result in disciplinary action up to and including termination of employment.
