37 No policy should be construed to confer any express or implied contractual relationship or rights to any Team Member. The Company reserves the right to modify any policy as necessary, in its sole discretion, to the extent permitted by law. Violation of any Company policies or procedures can result in disciplinary action up to and including termination of employment. IT Policies Computer and Device Use Policy Dealership computers and corporate networks (ABG-Corp-1 through ABG-Corp-3) are intended for Company business only. Asbury provides Team Member and Guest Wi-Fi to access non-Asbury systems using personal devices. All information on corporate owned devices and corporate networks is the sole and exclusive property of the Company and Team Members should not put personal data or other information on Company computers. The Company retains the right to access, monitor, and inspect its technology resources, and any of the data and files stored and/or transmitted therein, at any time. This applies even with respect to data or information transmitted or received using any of the Company’s technology resources, such as its networks or Internet connection, even if such is done using a Team Member’s personal device, such as a personal mobile phone, smartphone, or computer. This right applies both during a Team Member’s employment with the Company and after their termination for any reason, voluntary or involuntary. The Company is required by law to carefully safeguard our Guests’ information. Anyone who removes Company or Guest information from our premises or uses the information to benefit any person or entity other than our Company is guilty of theft. Team Members are prohibited from: your receipt of that document, we expect your full cooperation. If you disagree with the content of the document, you are always free to attach an explanation or a rebuttal. Refusal to acknowledge may result in disciplinary action, up to and including termination of employment. NOTE: Team Members should understand that nothing in this Policy or any other Company policy should be interpreted in a manner that unlawfully prohibits the right of Team Members to engage in protected concerted activity or otherwise interfere with the rights of employees to discuss or share information related to their wages, hours or other terms and conditions of employment under the National Labor Relations Act (“NLRA”). The Company respects the Section 7 rights of Team Members and has and always will comply fully with its obligations under the NLRA, and the Company emphasizes that this Policy does not intend to cover conduct engaged in by Team Members that is protected by the NLRA. Introductory Period Policy The first 90 days of employment is an introductory period for both new Team Members and the Company. The introductory period is officially completed coincident with or the first Sunday following 90 days of continuous employment. During this time, Team Members will have the opportunity to learn about the Company, the job and the new surroundings. The Company will review job performance, attendance, attitude, relationship and overall interest in the job. At the end of the introductory period, Team Members will receive a performance review that will either result in the successful completion of the introductory period or a performance improvement plan. Should a Team Member’s performance become unsatisfactory at any time during the introductory period, the Team Member will be terminated. However, any Team Member, during both their introductory period and subsequent employment with the Company, may be discharged at any time for any reason.
