44 No policy should be construed to confer any express or implied contractual relationship or rights to any Team Member. The Company reserves the right to modify any policy as necessary, in its sole discretion, to the extent permitted by law. Violation of any Company policies or procedures can result in disciplinary action up to and including termination of employment. If you have any questions about this handbook or Company policies, please feel free to discuss with your Manager or HR. Please direct all requests regarding this Policy to your HR Manager. If any state, local, or other applicable law provides additional protections for nursing mothers, the Company will comply with such law. The Company will provide the use of a clean room or other location (that is not a bathroom) in close proximity to the Team Member’s work area, where a nursing mother may express breast milk in private. The break time should, if possible, be taken concurrently with meal and rest periods already provided. These breaks will be unpaid for non-exempt Team Members, unless (1) the break time otherwise would be paid by the Company, (2) the Team Member is not completely relieved of duty for the entire break period, or (3) the break time is otherwise required by law to be paid. Exempt Team Members will be paid their full salary during all nursing break times, as required under the Fair Labor Standards Act (FLSA), or other applicable wage and hour law. License Plate Control Policy It is prohibited for Team Members to use any dealership dealer tags or drive off tags for personal use or on personal vehicles, and in many states, it is a crime to misuse a dealer or temporary tag. Any additional tags needed by a Guest that has purchased a vehicle must be approved by the GM and comply with applicable laws. When a Guest sells or trades a vehicle to the dealership, you must remove the vehicle tags and return them to the Guest. If the Guest forgets the tags, turn the tags into the accounting office with an explanation. Do not leave tags on a vehicle the Guest no longer owns. Loaner and Rental Program Policy • The Guest must provide an insurance card and a valid DL, copies of which must be included with the loaner agreement. Vehicles must never be delivered under any circumstances without collecting copies of an insurance card and valid DL. • The Loaner Agent must document the odometer, gas level and condition of the vehicle. • The Loaner Agent must take a $100 refundable deposit which should be charged to the payment card prior to delivery to cover incidentals like unpaid parking tickets or excessive wear and tear. Note: Credit Card Authorization Forms are prohibited. Have the Guest insert the card into the payment card reader. • The loaner agreement must be completed in full prior to delivery of the loaner. Hand written contracts or partially completed contracts are not acceptable. • If the loaner/rental is through an OEM program, comply with all applicable OEM policies as well. • Do not rent to Guests under the age of 25. • Team Members are prohibited from personal use of the Company’s loaner or rental fleet unless they are a service Guest and meet all of the above qualifications and pay the same applicable rates as regular Guests. Only approved loaner agents can provide a vehicle to a Team Member. Any exception must be approved by the Regional Fixed Operations Director. Violation of the Company’s Loaner and Rental Policy may result in disciplinary action, up to and including termination of employment. Nursing Mothers – Break Time The Company complies with applicable provisions of the Providing Urgent Maternal Protections (PUMP) for Nursing Mothers Act. Consistent with this statute, the Company provides all nursing mothers with a reasonable break time to accommodate their need to express breast milk, for up to one year following the birth of a child, except where state or local law requires a more extended time.
