Outside Employment Policy Team Members employed elsewhere while working for the Company must report that employment to the GM. Outside employment that results in a conflict of interest, interferes with work hours, impacts performance or adversely affects the safe operation of job-related duties is unacceptable and may result in discipline, up to and including termination. Overtime The Company may periodically schedule overtime or weekend work in order to meet business or Guest needs. An attempt to give Team Members as much advance notice as possible will be made. The Company expects all Team Members to be flexible regarding overtime work as required. In accordance with federal law, overtime pay is paid when a non-exempt Team Member works more than 40 hours in a week, or as otherwise required by applicable state law. All overtime must be approved in advance by a Manager. Paid Time Off (PTO), Holidays, and any other ‘Time Away From Work’ are not counted as “hours worked.” Exempt salaried Team Members do not receive overtime pay. Exempt salaried Team Members are subject to deductions from their salaries only for lawful reasons. If a Team Member feels they have been subject to an improper salary deduction, have been improperly classified as exempt or non- exempt, or have not been paid overtime for any hours worked over 40 in a workweek, or as otherwise mandated by applicable state law, the Team Member must utilize the Company’s Team Member Complaint Procedure, which is contained in this Handbook. In the event it is determined that an improper deduction was made or that a Team Member was not paid any overtime due, the Company will reimburse the Team Member as required by law.
45 No policy should be construed to confer any express or implied contractual relationship or rights to any Team Member. The Company reserves the right to modify any policy as necessary, in its sole discretion, to the extent permitted by law. Violation of any Company policies or procedures can result in disciplinary action up to and including termination of employment.
