65 No policy should be construed to confer any express or implied contractual relationship or rights to any Team Member. The Company reserves the right to modify any policy as necessary, in its sole discretion, to the extent permitted by law. Violation of any Company policies or procedures can result in disciplinary action up to and including termination of employment. If you have any questions about this handbook or Company policies, please feel free to discuss with your Manager or HR. 7. Exercise good judgment and common sense. Team Members engaging in Online Social Networking and Blogging Activities are expected to refrain from taking any action that would tarnish the reputation of the business. Team Members should not post any material that i) is obscene, vulgar, defamatory, threatening, discriminatory, harassing, abusive or hateful to another person or entity, or ii) contains any content prohibited by the Company’s policies and procedures. 6. Advertising and other laws apply to Online Social Networking and Blogging Activities just as with traditional marketing. Only Team Members who have been trained in Company brand standards, OEM requirements and advertising laws should be posting information about products and services and, unless approved from the Marketing Department, Team Members should not create the impression that they are speaking in any official capacity on behalf of the Company. Social Media Use on Behalf of the Company The following rules apply to social media activities conducted for Company business purposes, and by Team Members conducting themselves in a manner that may give the impression they are operating in an official capacity or on behalf of the Company. To the extent Team Members are authorized as part of their job duties to use social media accounts to advance the Company’s interests, the Company – not the Team Member – own the account and the Team Member is required to return all logins and passwords for such accounts at the end of employment. 1. Only Team Members approved by the Marketing and Human Resources department may maintain social media sites on behalf of the Company or its Dealerships. Team Members may not create any Online Social Networking Page or Blog to represent themselves as an Asbury Automotive dealership or entity. A Team Member should never misrepresent their title or position with the Company to the public. 2. Team Members are prohibited from using social media to post or display content that is an intentional public attack on the Company’s products and/or services in a manner that a reasonable person would perceive as calculated to harm the Company’s business or reputation and is unrelated to any employee concern involving their terms and condition of employment. Never create false reviews about the Company or its Competitors. Team Members may not leave reviews about Asbury’s products and/or services on any social media pages unless services have actually been performed. Many manufacturers will notate this and enact penalties for self-promotion. Any review left must coincide with an actual service performed. Similarly, Team Members may not leave reviews about the services of a competitor on competitor social media pages unless services have actually been performed, and the review coincides with an actual service performed. 3. Privacy and Safeguards. Never reveal private information about consumers, co- workers or other individuals, and never use social media to obtain, exchange or store confidential Company information. 4. Other Company policies apply to social media use. Team Members engaging in Online Social Networking and Blogging Activities are subject to all of the Company’s policies and procedures, including, but not limited to, the Company’s policies (i) prohibiting any type of employment discrimination or harassment, and (ii) governing confidentiality, privacy, safeguarding Guest information and use of the Company’s Electronic Systems. 5. Never misuse intellectual property. Likewise, Team Members are prohibited from improperly using the name, trademarks, logos, other identifying marks or copyright- protected material of the Company or its clients or manufacturer partners in any Online Social Networking and Blogging Activities, unless such Team Member receives prior approval from the Marketing Department.
