66 No policy should be construed to confer any express or implied contractual relationship or rights to any Team Member. The Company reserves the right to modify any policy as necessary, in its sole discretion, to the extent permitted by law. Violation of any Company policies or procedures can result in disciplinary action up to and including termination of employment. If you have any questions about this handbook or Company policies, please feel free to discuss with your Manager or HR. • Prohibited: “Here’s a picture of one of my Guests taking delivery of their new vehicle!” (This could raise consumer privacy and other concerns, especially with minors or if we do not obtain a Guest’s written consent to use their photograph) • Team Members may discuss personal achievements with the Company on personal social media, so long as the information is not confidential. • Permitted: “Yesterday’s dealership charity golf outing was a success! I was proud to organize it.” • Permitted: “I’ve completed my certification program and was promoted to master • Prohibited: “Send a picture of your DL and SS# to my social media account and I’ll get your deal started!” (Guest information must be stored on secure Company servers, only) • Prohibited: “I’ll be at work all day on Saturday, come test drive this vehicle, only $99,999 fully loaded!” (This statement is an “advertisement” and is missing important OEM and legal disclosures) Personal Social Media Use Do not engage in personal social media activities on work time. Any internet blogging, online social networking, or other form of online publishing or discussion activities (“Online Social Networking and Blogging Activities”) performed while on work time must be exclusively related to a Company business purpose. Some Team Members wish to use personal Online Social Networking and Blogging Activities to engage with the Company and promote their careers. This is permissible subject to the following rules and guidelines, which are designed to assist you in making responsible decisions about your personal use of lawful social media: • Only the Marketing Department and Team Members who are pre-approved by the Marketing Department and Human Resources may engage in Online Social Networking and Blogging Activities on behalf of the Company. All Team Members may, however, create or use an existing personal Online Social Networking profile to engage with Asbury’s pages. • Team Members may interact with Company’s pages by ‘liking,’ ‘sharing,’ and ‘following’ pages including Facebook, LinkedIn, GlassDoor and Twitter. Team Members should understand that they are personally responsible for the commentary they express and the material they post while engaging in Online Social Networking and Blogging Activities. • Team Members must make clear that the views and opinions they express about work- related matters are their own, have not been reviewed or approved by their employer, and do not necessarily represent the views and opinions of their employer. • Remember that online activity is oftentimes permanently available and open to being republished in other media. • Team Members may identify that they are employed by the Company and their position(s) with the Company on personal social media. If you choose to identify your affiliation with the Company on personal social media, be mindful that your personal Online Social Networking and Blogging Activities use may reflect on the Company. All Team Members, and particularly those in leadership roles, are urged to represent themselves with professionalism, dignity and integrity, particularly if you identify your employer in personal Online Social Networking and Blogging Activities. A Team Member should never misrepresent their title or position within the Company to the public. • Do not solicit or conduct business on behalf of the Company on personal social media. If you receive an unsolicited request to engage in business through personal social media, move the conversation to your Company account (work phone, email, CRM, etc.). Avoid discussing Company products or services on social media.
