85 No policy should be construed to confer any express or implied contractual relationship or rights to any Team Member. The Company reserves the right to modify any policy as necessary, in its sole discretion, to the extent permitted by law. Violation of any Company policies or procedures can result in disciplinary action up to and including termination of employment. If you have any questions about this handbook or Company policies, please feel free to discuss with your Manager or HR. To qualify for an unpaid Personal LOA the Full Time Team Member must have successfully completed their introductory period. Unpaid Personal LOA must be requested using the Company form and submitted for approval through DocuSign to the GM/Controller, MMD/RVP/SVP and HR. The reason for the leave and business conditions will be taken into consideration. At no time will a Team Member be allowed to take a personal leave for personal gain. The Team Member will remain responsible for the cost of any elected benefits while on personal leave. Failure to make these payments could result in the loss of the elected benefit. The request for personal leave cannot exceed 30 days and cannot be used intermittently. Initiate leave through Unum 866-779-1054 www.unum.com • Team Members should discuss with their Supervisor and HR Manager the dates that they will be out for Military Duty and provide them with a copy of their Military orders to save in their personnel file. • Team Members should contact Unum immediately and initiate their Military Leave by phone or they can initiate through Unum’s website. • Team Members should provide Unum with a copy of their Military orders for approval of the leave. • If the Military orders change, the Team Member should notify Unum immediately of the change and provide Unum with their new Military orders. • Team Member should notify and provide their Supervisor and HR Manager with any updates or changes to the Military orders. Upon Return from Military Leave • Team Member should contact their Supervisor and HR Manager prior to returning back to work to discuss a return to work date. • The Supervisor and or HR Manager will email the FMLA email box with the Team Members’ return to work date so the Team Member can be made active and granted access back into the system. Initiate leave through Unum 866-779-1054 www.unum.com Personal Leave of Absence - Unpaid (PLOA) • A request to substitute paid leave for unpaid FMLA leave or a request for any leave not covered by the FMLA may be subject to additional approval, certification, and reinstatement requirements. • Team Members requesting to substitute paid leave for unpaid FMLA leave or requesting other approved leave will be required to complete all applicable forms. Complaint Procedure If you believe you have been denied any right under the FMLA or otherwise discriminated against because of your use of FMLA leave, please utilize the Company’s Team Member Complaint Procedure, which is contained in this Handbook. Military Leave The Company will comply with its obligations for those Team Members who serve in any branch of the United States uniformed military services, including providing any necessary time off, in accordance with federal, state, and local law. Team Members who are eligible to take military leave must comply with all applicable requirements. How to initiate Military Leave • Once a Team Member is notified that he/she will need to take a Military Leave, Team Member should contact their Supervisor and HR Manager immediately.
