IV. Top FLSA / Wage & Hour Class And Collective Settlements In 2024 In 2024, the top ten wage & hour settlements totaled $614.55 million. This was a decrease over 2023, when the top ten wage & hour settlements totaled $742.5 million, but in line with the trend in recent years.

1. $233 million – Grace, et al. v. The Walt Disney Co., Case No. 30-2019-01116850 (Cal. Super. Ct. Dec. 13, 2024) (preliminary settlement approval sought in a class action to resolve claims from over 51,000 workers alleging that Walt Disney Co. failed to follow Anaheim’s $15 minimum wage ordinance). 2. $175 million – Campbell, et al. v. Uber Technologies , Case No. 2084-CV-01519 (Mass. Super. Ct. June 28, 2024), El Kousa, et al. v. Campbell , Case No. SJC-13559 (Mass. June 28, 2024), and Craney, et al. v. Campbell , Case No. SJC-13567 (Mass. June 28, 2024) (settlement agreement following trial for consolidated class actions alleging Uber and Lyft took advantage of drivers by treating them as independent contractors when they qualified as employees under state law). 3. $72.5 million – Utne, et al. v. Home Depot USA Inc., Case No. 16-CV-1854 (N.D. Cal. Mar. 8, 2024) (final settlement approval granted for a class action to resolve claims that the company failed to pay hourly wages, pay final wages on time, and provide accurate written wages). 4. $38 million – In The Matter Of The Investigation Of Letitia James, Attorney General Of The State Of New York Of Lyft Inc ., AOD No. 23-041 (AG Labor Bureau Nov. 30, 2024) (settlement based on the New York Attorney General investigation against Lyft, claiming the ride-booking company withheld wages from drivers by deducting taxes and fees from their pay instead of having passengers pay those expenses and prevented drivers from receiving the benefits they were entitled to under New York law). 5. $21 million – Wilder, et al. v. The Kroger Co., Case No. 22-CV-681 (S.D. Ohio Nov. 26, 2024) (preliminary settlement approval sought in a class action to resolve claims from nonexempt workers who alleged they were adversely impacted when the company’s cloud-based timekeeping and payroll system failed to pay for all hours worked for several months).
