Insurance - PASSED House Bill 1611, by Representative Stevenson (companion Senate Bill 1622, by Senator Trumbull). The legislation amends multiple statutes regarding the Office of Insurance Regulation (OIR), effective July 1, 2025. The OIR regulates specified insurance products, insurers and other risk bearing entities in Florida. As part of its regulatory oversight, the OIR may suspend or revoke an insurer’s certificate of authority under certain conditions. The legislation strengthens insurance oversight, implementing adjustments to market conduct examinations, insurer reporting mandates, issuance of insurance policy nonrenewal notices, public housing authority self-insurance fund criteria, restrictions on specific policy cancellations or nonrenewal, rate filing stipulations and definitions associated with insurance practices. Access to Financial Institution Customer Accounts - FAILED House Bill 585, by Representative Rommel (companion Senate Bill 1132, by Senator Martin never had a hearing). The legislation would have amended sections 280.051 and 280.054, Florida Statutes, as well as created section 655.49, Florida Statutes. The legislation would have increased oversight and accountability for financial institutions restricting access to or terminating customer accounts. It would have created a complaint filing and review process within the Office of Financial Regulation for account suspensions believed to be made in bad faith, as well as administrative penalties against financial institutions found culpable of conducting bad faith account suspensions or terminations. Claims Against Assisted Living Facilities - FAILED Senate Bill 238, by Senator Burton (companion House Bill 995, by Representative Chamberlin). The legislation would have amended sections 429.29 and 429.297, Florida Statutes. The legislation would have provided civil liability procedures and protections for claims brought against assisted living facilities, like those previously created for claims against Florida’s nursing homes. It sought to clarify the list of individuals associated with assisted living facilities who could be held liable for violations of residents’ rights and other negligence actions, exempting individuals identified solely as “passive investors.” It would have also limited the amount of damages recoverable in civil negligence and residents’ rights violation cases, while increasing the legal requirements and standards for recovering punitive damages.
