Supported Decision-making Authority - PASSED (AARP Supported)

House Bill 73, by Representative Tant (companion Senate Bill 446, by Senator Simon). The legislation amends chapters 393, 709 and 744 Florida Statutes, effective July 1, 2024. Supported decision-making (SDM) is one alternative to guardianship. With SDM, an individual with a disability retains their right to make life choices with the support of trusted friends and/or family members. The legislation creates an SDM agreement under Florida’s Power of Attorney law. It requires the court to consider the unique needs and abilities individuals with developmental disabilities before determining whether to appoint guardian advocate or guardian. It also provides an option for the court to consider restoration of rights previously removed.
