House Bill 1093, by Representative Caruso (companion Senate Bill 1316, by Senator Berman). The legislation amends chapter 738, Florida Statutes, effective January 1, 2025. The legislation replaces the current Florida Uniform and Principal Income Act with the Florida Uniform Fiduciary Income and Principal Act, which governs the allocation of trust and estate receipts and disbursements. It also modernizes Florida trust law by providing for the conversion of an existing trust into a unitrust, greater flexibility for more individualized estate planning and governing law to reduce jurisdictional disputes.
