Builder Warranties - PASSED (AARP Supported)
House Bill 623, by Representatives Steele & Anderson (companion Senate Bill 966, by Senator Burgess). The legislation creates section 553.837, Florida Statutes, effective July 1, 2025. The legislation requires builders to provide certain limited warranties for at least a year following the conveyance or occupancy of all newly constructed homes. It requires that the builder repair any qualifying defects at the builder’s expense and that the builder must honor the warranty if the home is transferred to a new owner within the warranty period. While this legislation creates minimum standards for builder warranties on new constructed homes, it does not prevent or supersede warranties providing greater protections to homeowners. AARP supported the legislation as originally filed, which afforded written disclosure requirements to new owners and created unfair and deceptive trade practice penalties for builders who failed to perform their obligations under warranty. These provisions were later removed because of floor actions taken in both chambers.
