Schemes to Defraud - PASSED (AARP Supported)

House Bill 1171, by Representative Steele (companion Senate Bill 1220, by Senator Martin). The legislation amends section 817.034, Florida Statutes, effective October 1, 2024. The legislation enhances the penalties for certain fraudulent conduct, including the reclassification of fraudulent offenses to a higher degree when they are committed against a person 65 years of age or older. It also expands the definition of “scheme to defraud” to include false endorsements by nonconsenting parties and provides a civil remedy to persons whose image or likeness was used in a scheme to defraud without their consent.
