Senate Bill 356, by Senator Avila (companion House Bill 1255, by Representative Porras). The legislation would have amended section 28.47 and multiple sections of Chapter 117, Florida Statutes. The legislation would have enhanced regulations for notary publics by requiring that notaries properly record information of all witnesses to, as well as maintain a journal with a complete record of, all performed notarizations. It would have clarified and established new criminal penalties for falsely notarizing documents, especially those related to real estate transactions. It would have granted county property appraisers the authority to refuse to update the owner of record on real property for tax purposes if the property appraiser reasonably determined the recorded deed to be fraudulent.
