The legislation creates a series of disclosures an attorney must provide when seeking to represent a personal representative in a probate proceeding or trust administration. The disclosure must state that the attorney fee is not required to be based on the value of the estate or trust, may be subject to negotiation and selection of the attorney is at the discretion of the personal representative or trustee. The legislation is Chapter No. 2021-205, effective upon becoming a law. AARP supported this legislation. The legislation requires an online notary to verify a principal’s and witnesses’ identities for any electronic record. It updates forms used by notaries public and online notaries to reflect how (by physical presence or by audio-video technology), the record signatories appeared before the notary. The legislation is Chapter No. 2021-185, effective July 1, 2021. AARP supported this legislation. The legislation requires all sales calls, text messages, and direct-to-voicemail transmissions to have the receiving consumer’s prior express written consent if the call is made using an automated machine to dial the recipient’s phone number or plays a recorded message upon connection. It prohibits telephone sellers and salespersons from calling a consumer more than three times over a 24-hour period about the same subject matter. It limits the calling time to the hours of 8 a.m. and 8 p.m. It creates a private right of action to enforce the law. *SB 1682, by Senator Gruters, was amended onto See SB 1120.
