Consumer Finance Loans SB 1478, by Senator Gibson, FAILED. The companion bill was HB 895, by Representative Stevenson. AARP supported this legislation. The legislation would have prohibited prepayment penalties for consumer finance loans. Beginning Oct. 1, 2021, it also would have required all consumer finance loans, including refinances, to have minimum loan terms of 6 months. See Voting Record for SB 1478 p. 88 & HB 895 p. 88. Recovery of Damages in Claims for Medical Negligence HB 651, by Representative Roach, FAILED. The companion bill was SB 1112, by Senator Rodriguez (A). AARP supported this legislation. The legislation would have authorized a parent of a child, 25 years old or older with no surviving spouse or children, to recover for the child’s mental pain and suffering in a medical malpractice wrongful death action. See Voting Record for HB 651 p. 89. Quality of Long-Term Care Facility Improvement Trust Fund (TF) HB 6065, by Representative Mariano, FAILED. The companion bill was SB 1880, by Senator Rodrigues (R). AARP monitored this legislation. The legislation would have deleted the requirement that punitive damages awarded in a claim against a nursing home or an ALF be split equally between the claimant and the TF. A plaintiff would have been able to keep the entire amount of punitive damages awarded. Consumer Data Privacy SB 1734, by Senator Bradley, FAILED. The companion bill was HB 969, by Representative McFarland. AARP monitored this legislation. The legislation would have created the Florida Privacy Protection Act. Consumers would have been able to review personal information collected by companies and would have been given the opportunity to delete or correct the information. It would have allowed civil lawsuits if companies collected and sold personal data after being told not to do so.
