The legislation requires the Office of Insurance Regulation to conduct a study to evaluate Florida’s essential health benefits (EHB) benchmark plan (see SB 322, above) and to submit by October 2019 a report to the Governor, the President of the Senate, and the Speaker of the House which includes recommendations for changes.

Hospital Licensure House Bill 21 and Companion Senate Bill 1712 The certificate of need (CON) program, administered by the Agency for Health Care Administration (AHCA), has required hospitals, nursing homes, hospices, and intermediate care facilities for the developmentally disabled (ICF/DD) to obtain authorization from the state before constructing new facilities or offering certain new or expanded services. The legislation eliminates the CON requirement for “new general hospitals and tertiary services.” Tertiary services include such things as organ transplants, pediatric open-heart surgeries and neonatal intensive-care units. The legislation is now Chapter No. 2019-136, Laws of Florida, effective July 1, 2019. Assisted Living Facilities House Bill 1349 and Companion Senate Bill 1592 An assisted living facility (ALF) is a residential establishment that provides housing, meals, and one or more personal services for a period exceeding 24 hours to one or more adults who are not relatives of the owner or administrator. The legislation would have: • Authorized and encouraged the use of safety devices to protect residents in ALFs. • Updated the fire safety code that all ALFs must meet. • Clarified core training requirements for ALF staff and administrators. • Required ALFs to investigate adverse incidents within 24 hours and to provide reports to AHCA within 15 days. • Provided requirements for the medical assessment that residents must undergo in to determine whether placements in ALFs are appropriate. • Required all ALFs when providing notices of eviction to residents to provide written information about the Long-Term Care Ombudsman Program.
