Elder and Vulnerable Adult Abuse Fatality Review Teams - PASSED (AARP Supported) Senate Bill 1540, by Senator Garcia (companion House Bill 1567, by Representative Hawkins). The legislation amends section 415.1103, Florida Statutes, effective July 1, 2023. In 2020, Florida law authorized the creation of Florida’s first-ever Elder Abuse Fatality Review Teams (EA-FRTs) to operate throughout the state. The purpose of each team is to review cases of elder abuse-related deaths to identify gaps and areas for improvement and recommend policy changes to prevent future elder abuse deaths. This legislation expands the scope of EA-FRTs to now allow teams to review all vulnerable adult abuse-related fatality cases (including cases of elder and disabled adult abuse), as well fatalities caused by or related to exploitation. Additionally, this legislation expands the listed agencies which may initiate a fatality review team, as well as provides discretion for each team to determine its operations and methods for identifying and selecting cases for review. Finally, it permits fatality review teams to review cases in which a criminal prosecution has not yet occurred, which will allow for increased identification of cases qualifying for review and for expedient policy reviews and recommendations to be made these teams.
