Withholding or Withdrawal of Life-prolonging Procedures - PASSED (AARP Supported) House Bill 1119, by Representative Berfield (companion Senate Bill, by Senator Burton). The legislation creates section 744.4431 and amends numerous sections within 744, Florida Statutes, effective July 1, 2023. Three years ago, lawmakers passed legislation aimed at protecting persons under guardianship from guardians inappropriately agreeing to “Do Not Resuscitate Orders” (DNRO) on their behalf. It required the court to hold a hearing and determine whether a DNRO could be entered. Unfortunately, the courts were unable to promptly hear and decide on requests for DNRO’s in every case. This legislation requires the court to consider a person’s preexisting advance care health plan, including who serves as surrogate in enforcing those wishes, whenever practicable. It also creates clear processes for professional guardians to obtain court approval for executing a DNRO, carve outs for when court approval is not a prerequisite to entering a DNRO and ensures the court is timely notified of any new DNRO. This legislation also specifies that a professional guardian may not unilaterally enter a DNRO if the person under guardianship, their next of kin, or the person’s attorney have an objection to the DNRO.
