House Votes on HB 1267 & SB 580
Consumer Finance Loans- PASSED (AARP Opposed) House Bill 1267, by Representative Fernandez-Barquin (companion Senate Bill 580, by Senator Gruters). The legislation amends several sections of 516, Florida Statutes, effective July 1, 2023. This legislation revises laws governing consumer finance loans, which are loans of $25,000 or less for which a lender charges an interest rate greater than 18 % per annum. It increases the maximum interest rate that may be charged to from 30% to 36% and removes the tiered interest rate structure. The legislation also provides requirements and timeline of written notice that must be send to borrowers impacted in the event of a Federal Emergency Management Agency (FEMA) response to a Presidential Disaster Declaration in Florida. Finally, it requires licensees to file annual reports to the Office of Financial Regulation and provides guidance as the information that shall be included within the report and report due date.
