Guardianship – WITHDRAWN (AARP Opposed) House Bill 297, by Representative Caruso. The legislation was withdrawn prior to introduction. This legislation would have created several new legal processes and requirements to Florida’s guardianship process, including: 1) the creation a rotating appointment process for public guardians; 2) the requirement of a jury panel determination regarding the validity of a person’s previously executed trust, power of attorney, or will during the determination of capacity process in guardianships; 3) a legal presumption in favor of preserving contact and visitation rights by a person under guardianship with his or her family members; 4) the right of beneficiaries and heirs of the person under guardianship to receive inventory and accounting information from the guardian; and 5) the requirement for a full reevaluation and rehearing of the need for guardianship every three years by a new judge. Because this bill was withdrawn prior to introduction, AARP did not take an official position opposing this legislation. AARP worked with the bill sponsor to improve portions of this legislation that is consistent with AARP’s policy to protect the due process rights of people under guardianship, while seeking to remove language which could unintentionally facilitate exploitation or abuse in guardianship cases.

Claims Against Long-term Care Facilities - FAILED (AARP Opposed)
Senate Bill 1304, by Senator Burton (companion House Bill 1029, by Representative Maggard). The legislation would have repealed sections 400.0235 and 429.95 created section 429.299 and amended multiple sections of 400 and 429, Florida Statutes. This legislation posed a huge risk to older adults in nursing homes and would have eroded long-term care residents’ rights. It would have made it difficult to sue nursing homes and other long-term care facilities after the wrongful death of a resident. It would have permitted that only a living spouse or child under 25 could sue a facility, drastically changed the credentials required of expert witnesses that testify against a facility, created additional pretrial obstacles for prosecutors to navigate, and significantly reduced the amount of time someone had to file a claim.
