UPDATES ON SLG TRIAL SCHEDULE JURY TRIALS HAVE RETURNED

We started our first jury trial in a trucking case the first week of August. We were assigned out to a judge. The judge heard pretrial motions. After the motions were decided, the defending trucking company made the highest offer in the case. Our client decided to accept the offer, and the family is pleased to resolve this most sensitive matter. I will report more on the case later, but I commend Patrick Cummings, Patrick Anderson, and our associated counsel Greg Leiter for all their dedication and great work on the case. These lawyers put their hearts and souls into delivering for this terrific family. This was a big moment for our clients. Before the pandemic, our firm handled trials regularly and expeditiously. The wait for a jury trial would max out at three years. We are pleased the courts are back on track. Our next major trial involves our client who was a career police officer who responded to an accident scene. There were flashing lights all around, warning motorists to yield and slow down. Despite all of the warnings, a negligent driver plowed into our client’s police cruiser. The injuries from this ended his career as a policeman. We are grateful we will finally be able to put his case before a jury of his peers. It is a simple fact that the civil justice system only works when clients gain their rights to have their case tried expeditiously before an independent judge or a jury. For the last two and a half years, jury trials have been nonexistent. During that time, insurance companies have prospered because they were not forced to pay reasonable settlements. Why? Because they were not required to defend their cases before real people who understand what it’s like when a loved one is killed or when a client is no longer able to financially provide for themselves or their family. In the case of our police officer client, he had worked hard to qualify for his pension. But he needed to be on the job for a certain number of years. The negligent driver ended that. In America, we all run our own economies. If our clients can’t work because of someone else’s negligence, that leaves a major void. In my experience, juries of regular people understand these losses very well.

Here’s some “inside baseball” for you. Although our cases list only the parties involved, most of the time, our client’s case is against an unnamed insurance company. The insurance company does not appear in the courtroom, and does not appear on the jury verdict form. In some states, that is not the case. For example, in Wisconsin, the insurance company is named as a defendant and is named on the jury verdict. In Illinois, the insurance company is not on the jury verdict. However, we know precisely who makes the decisions on whether to pay a fair settlement to our clients when their injuries are caused by negligence or recklessness. It’s the insurance company. As lawyers, we are blessed to have the honor and privilege to serve you and your families. Thank you for allowing us to do so.

HOW TO REPORT AN ADVERSE VACCINE REACTION TO VAERS

August is National Immunization Awareness Month. Vaccines have saved millions of lives across the United States. But like any medical treatment, there are rare side effects that can happen. At our firm, we have a robust vaccine injury practice to help these folks navigate the Vaccine Injury Compensation Program. People who suffer side effects from vaccinations can report their symptoms to the Vaccine Adverse Event Reporting System (VAERS). This program assists the Department of Health and Human Services to detect and track potentially unsafe vaccines in the U.S.

for inclusion in its database. This data is beneficial for making determinations regarding the safety and efficacy of a particular vaccine.

Submitting an Adverse Event to VAERS

No matter what the side effect, you can report it to VAERS without having to go through a health care provider at VAERS.hhs.gov/reportevent. You can also report the adverse reaction to your health care provider. Physicians are required by law to report adverse reactions to VAERS under specific circumstances.

Why It’s Important to Report Vaccine Adverse Reactions

I encourage our clients to report their vaccine injuries to VAERS. The more information we have regarding vaccines and their side effects, the better. Ultimately, the goal is to produce a safe product, and VAERS is an important tool for that goal.

The purpose of VAERS is data collection. It helps to identify trends in the safety of vaccines as well as identify the incidence of a particular side effect. For that reason, people are encouraged to report potential side effects of vaccines to VAERS regardless of whether the exact cause is known.

It is designed to be over-inclusive and allows anyone to report a possible side effect or adverse event following a vaccine
