5. PRIVATE SALES 5.1 Any sale concluded between a Purchaser and a Vendor within seven calendar days following the last day of the Sale at which the Lot was unsold or bought in by the Vendor and is deemed to be a Private Sale shall be subject to the Conditions of Sale. Such transactions must be finalised in writing on a Private Sale Form signed by the Vendor, the Purchaser and an authorised representative of Go!s. For the avoidance of doubt, this includes any sale conducted online. The terms of Condition 7 below will apply to the Purchaser. 5.2 Where Go!s accepts the transfer of a Lot from the Purchaser to a third party (the New Purchaser), the appropriate Private Sale Form must be completed in the Sales O"ce. The terms of Condition 7 below will apply to the new Purchaser. 5.3 Any Private Sale is subject to the terms outlined in the Basis of Sale (Condition 4). 5.4 The Complaints Procedure set out in Conditions of Sale 9 and 10 will apply to a Private Sale if any condition listed in Condition of Sale 10 is not stated in the Catalogue, is not announced by the Auctioneer or is not declared by the Vendor on the Private Sale Form. For the avoidance of doubt, this declaration at the time of signing the Private Sale Form is required regardless of whether the condition was announced by the Auctioneer at the time the Lot was o!ered for sale in the ring. 5.5 Where a Purchaser is disputing their obligation to pay for any Lot pursuant to a Private Sale then Go!s may withhold payment to the Vendor pending resolution of the dispute or where Go!s has made payment to the Vendor then the Vendor shall repay to Go!s, on demand any payment made to the Vendor by Go!s in respect of the private Sale. PASSING OF RISK AND TITLE 6.1 The Lot will be at the Vendor’s risk 6.
at all times until the Lot is collected by the Purchaser at the Vendor’s premises, from when the Lot will be at the Purchaser’s risk. 6.2 Notwithstanding the passing of risk in this Condition or delivery of the Lot to the Purchaser, the Vendor shall retain title to the Lot until the full purchase price has been paid to Go!s. 6.3 Where Go!s have paid out the Vendor in accordance with 3.9 above, title of the Lot will vest in Go!s on the same terms as 6.2 above. 7. PURCHASERS 7.1 Go!s will issue the Purchaser a confirmation of purchase, allowing the Purchaser to collect the Lot from the Vendor’s premises in accordance with Conditions 3.8 & 3.9. 7.2 Subject to Condition 7.6, payment must be made in Euro by the Purchaser for each Lot on the day of the Sale unless, prior to the Sale, Go!s agree to other payment terms at their discretion. In the event that payment is not received under the agreed terms, Go!s will endeavour to collect the debt by whatever means are deemed appropriate. 7.3 The Purchaser shall take delivery of the Lot in accordance with Conditions 3.8 & 3.9 and within 14 days of the Lot reaching five months, or at a time mutually agreed with Go!s and the Vendor. If the Purchaser has not taken possession of the Lot within that time, the Vendor may charge an amount not exceeding €50 per day for each day, or part thereof, of subsequent delay. 7.4 If a Purchaser has paid for a Lot, and has not taken possession of a Lot within 14 days of the Lot reaching five months, or at a time mutually agreed with Go!s and the Vendor, Go!s reserve the right to cancel the sale and pay to the Vendor any monies due to the Vendor for the Lot, provided that payment has been received for the Lot by the Purchaser.
