▪ Cargo is discovered to be off specification, for example after obtaining and analysing first foot samples. ▪ When a specific sample drawn from the vessel is observed to contain contamination - particulates, sediment, water, cloudiness, colour etc. ▪ When samples are taken from the shore side that are contaminated and the likely source of contamination is from the vessel e.g. inert gas soot.
important that the title, and there is nothing legally which differentiates between Letter of Protest, Notice of Apparent Discrepancy, or Letter of Reserve, normally they do tend to be issued as follows:
• Free water:
o Free water found onboard after loading
o In-transit increase in free water.
• Tank reference height discrepancies
• Letter of Protest : Usually issued when an operational issue occurs.
o Discrepancies between the tank reference and observed gauge heights.
• Notice of Apparent Discrepancy : Typically issued when volumes do not agree with a stated tolerance, with the exception of bunker deliveries where Letters of Protest are expected to be issued.
• Cargo Spillage
o Any observed or recorded cargo spillage.
• Clients' procedures not followed:
• Remaining on Board (ROB)
• Letter of Reserve : Commonly used on Agricultural Inspections.
o For instance, when a vessel does not follow a stipulated load or discharge plan as indicated by the client.
o Liquid, free flowing ROB.
o Substantial (non-typical) amounts of cargo remaining on board. o ROB after discharging greater than OBQ before loading.
If you are in any doubt as what to issue, default to “Letter of Protest”.
• API or other agreed industry standard not adhered to, such as:

o Not being permitted to take our own measurements.
• Cargo found in void spaces
The below is a non-exhaustive list of when a Letter of Protest or Notice of Apparent Discrepancy should be issued.
o Any quantifiable cargo in void spaces, ballast tank, cofferdams.
o Not being allowed to take our own samples and/or use our own equipment.
• Cargo transferred during the voyage.
o Discrepant VEF data that cannot be resolved i.e. missing voyages, inconsistent units of measure, no raw data to support information on voyage leg etc. o Unslotted or inadequately slotted standpipes used for gauging or sampling
15.1.4.1 Letters of Protest (vessel/barge related)
o Any unauthorised change in cargo stowage
• Cargo quality issues:
• Seals on valves found to be broken.
o Any quality or potential quality related issue, such as:
o Seals that have been added to cargo tanks hatches, sea valves etc. that are observed broken.
