AND HOW TO PROVE FAULT THE NECESSARY PARTS OF A SLIP-AND-FALL CASE
We’ve all probably slipped and fallen at some point in our lives. At best, slips and falls leave us a little flustered and embarrassed. At worst, they might leave us injured, resulting in a hospital stay, a fight with an insurance provider, and a lawsuit. While that might sound overblown, an entire area of personal injury law is dedicated to slips and falls and how to navigate the legal waters that surround them. The Necessary Components In order to have the grounds to pursue a slip-and-fall case, you need to prove there was a dangerous condition you couldn’t have foreseen under normal circumstances (say, a slippery tile floor with no wet floor sign) and a party responsible for causing that dangerous condition (i.e., a store owner who neglected to indicate that the floors were wet). If you can prove that you have these two components, you could have grounds for a slip-and-fall case. While that might seem easy enough, it’s only the beginning. How to Prove Fault Each slip-and-fall case is unique, so there isn’t a precise way to determine when someone is legally responsible for your injuries. However, you must prove 1) that the property owner created the
dangerous condition, 2) that the owner knew it existed
and didn’t do anything to fix it, or 3) that the dangerous condition had existed for so
long that the owner should have fixed it
before someone got hurt. Any of these circumstances would mean that the property owner
both knew about and should have prevented the dangerous condition, which means you should have grounds to file a personal injury claim against them.
