AICC: Labor Updates on Pregnancy, Religious Accommodation AICC, The Independent Packaging Association, has an- nounced two labor law updates in connection with the new Pregnant Workers Fairness Act and the U.S. Supreme Court’s decision on religious accommodation. On June 27, a new law went into effect that requires employers with 15 or more employees to provide reason- able accommodation for an employee or applicant with known limitations due to pregnancy, childbirth, or related medical conditions. This may include an individual who is pregnant, trying to become pregnant, or was recently pregnant. No disabil- ity is required. The EEOC published their updated labor poster on the same date. The EEOC has already announced that it is ac- cepting charges of discrimination under this new statute. To avoid the $659 fine for failing to post the current poster, companies should replace their existing poster with the current poster. Also, organizations with an employee handbook should consider adding a related policy. “I am honored to lead the EEOC as we enforce a new civil rights law. For workers and job applicants, the PWFA will help ensure economic security at a critical time in their lives,” said EEOC Chair Charlotte A. Burrows. “The EEOC stands ready to support employers as they carry out the PWFA's directives and to support workers in receiving the accommodationg they are entitled to under the PWFA.” On June 29, SCOTUS modified the standard for pro- viding reasonable accommodation under Title VII of the Civil Rights Act of 1964 for an individual’s sincerely held religious belief. This covers employers with 15 or more employees. An accommodation is reasonable where it does not pose an “undue hardship.” The Court held that an undue hardship must be more than “de minimis,” which has been the inter- pretation in the past. Moving forward, “undue hardship is shown when a bur- den is substantial in the overall context of an employer’s business.” An undue hardship is not one that “is imposed by tem- porary costs, voluntary shift swapping, occasional shift swapping, or administrative costs.” Companies that already have a reasonable accommo- dation policy in an employee handbook that covers preg- nancy and religion, should consider updating them. Companies without an employee handbook are urged to create one policy that covers reasonable accommoda- tion for disability under the Americans with Disabilities Act to address pregnancy and religious observance. This en- ables organizations to cover all bases in one policy, rather than three. For more information, visit eeoc.gov .
