This guide is created and distributed by the sta ff of the Louisiana State Medical Society. Its purpose is to educate pa Ɵ ents on the poli Ɵ cal issues that impact their care and the prac Ɵ ce of medicine. It will be updated by the Society as issues and needs change. Resources on Advoca Ɵ ng Most people fi nd themselves in Ɵ midated when it comes to talking to elected o ffi cials. It’s hard to remember they work for you and can help when issues need a bigger stage. We’ve compiled some Ɵ ps and resources that may help you get started! Let’s start with fi nding out who represents you. The Louisiana Legislature hosts a simple web form to help you fi nd this informa Ɵ on. (h Ʃ ps://legis.la.gov/legis/FindMyLegislators.aspx) All you have to do is type in your mailing address and the form does this rest. Your state and federal representa Ɵ ves should be provided to you when using the tool. Click on each name to gain access to contact informa Ɵ on, biographies, sta ff names and more. B Now, think about what your want to say. This is your story to share. No one knows it be Ʃ er than you do. Collect your thoughts so you don’t become ra Ʃ led. This will also help you to be more concise. You’ll only have some much Ɵ me to make your point and ask for your legislators support or ac Ɵ on. Think through any ques Ɵ ons that may get asked of you. Understand it’s okay not to have answers, but it’s not okay to make them up. C
It goes without saying that you want to be polite and respec ƞ ul. Lore abounds in legisla Ɵ ve arenas of the cons Ɵ tuents who are rude, ugly and threatening. Send an Email If you have a direct email address to use, this is a great, fast way to share your comments with a speci fi c person. Make a Call Reserve this for urgent needs such as a pending vote. And then… Almost all legislators have online tools to connect you to them. It should be accessible from the informa Ɵ on you received in Step 1 above. You will be limited to the website’s space restric Ɵ ons.
Prior Authoriza Ɵ on Health plans tout prior authoriza Ɵ on (PA) as a cost-saving measure, but they may not be disclosing
the full consequences of PA on your well-being. When you need medical care, you turn to your physician. Unfortunately, PA requirements force physicians to contact the health plan or pharmacy bene fi t manager to get approval for certain treatments before they can administer care. You can wait days, weeks, or even months for approval. Result? Your health su ff ers, poten Ɵ ally leading you to take sick days or being less produc Ɵ ve while at work and home. Adding to the confusion for pa Ɵ ents like yourself is the reality that the unknown face denying your care is more o Ō en than not an individual without medical training , such as a nurse, a pharmacist or a therapist. Your physician must then spend addi Ɵ onal Ɵ me fi gh Ɵ ng your insurance company to give you the care you’ve paid for and need.

Among the 91% of surveyed physicians who treat pa Ɵ ents between the ages of 18 and 65 and currently in the workforce, more than half (51%) report that PA has interfered with a pa Ɵ ent's ability to perform his or her job responsibili Ɵ es. At the end of the day, PA isn’t “cheap” when it interferes with maintaining a healthy, produc Ɵ ve lifestyle. The care delays, abandonment, and denials related to PA can lead to signi fi cant nega Ɵ ve clinical outcomes for everyone. In fact, over one-third (34%) of physicians report that PA has led to a serious adverse event, such as hospitaliza Ɵ on, disability, or even death, for a pa Ɵ ent in their care. PA can prevent you from being able to use the bene fi ts already paid for via subsidies and premiums. What is the value of health care bene fi ts if you can’t receive Ɵ mely care—or are forced to pay for treatments out of pocket? Health plans agreed to make changes to improve the PA process several years ago, but surveyed physicians report sluggish progress on these reforms. Now is the Ɵ me for pa Ɵ ents, employers and regulators to demand transparency from health plans on the growing impact of prior authoriza Ɵ ons.
Ongoing poli Ɵ cal e ff orts to curtail prior authoriza Ɵ on...
In Louisiana… During the 2022 regular legisla Ɵ ve session, LSMS and other groups asked Sen. Robert Mills of Shreveport to introduce SB 112. SB 112 mirrored legisla Ɵ on passed in Texas called the “gold card bill” and would have provided signi fi cant relief from prior authoriza Ɵ on requirements. Despite compelling stories from pa Ɵ ents and in-person tes Ɵ mony from physicians, the Louisiana Senate Insurance Commi Ʃ ee was not inclined to report the bill as wri Ʃ en. Instead the commi Ʃ ee chose to require each insurance company to develop and post its own version of prior authoriza Ɵ on relief for providers. In this posture, the legisla Ɵ on completed the full process and became Act 432. While this is a unique step forward, we remain commi Ʃ ed to working towards further fi xes in the system. At present, this includes seeking two addi Ɵ onal common-sense requirements of insurance companies: 1. Known as guarantee of payment, we hope to pass legisla Ɵ on requiring insurance companies to pay when they have required a prior authoriza Ɵ on and have given that prior authoriza Ɵ on. 2. A peer-to-peer review of your needs should be done between your physician and another physician who understands your condi Ɵ on. Our hope is to require insurance companies to u Ɵ lize physicians in the same specialty as your physician when conduc Ɵ ng a review.

In Congress… The American Medical Associa Ɵ on and nearly 120 physician organiza Ɵ ons are strongly suppor Ɵ ng proposed reforms of prior authoriza Ɵ on in Medicare Advantage and the Medicare prescrip Ɵ on drug bene fi t. Working with the Centers for Medicare and Medicaid Services, the groups con Ɵ nue to urge the agency to fi nalize proposed reforms that target the inappropriate use of prior-authoriza Ɵ on requirements by Medicare Advantage plans to delay, deny and disrupt the provision of medically necessary care to pa Ɵ ents. Recent developments suppor Ɵ ng the need include: An inves Ɵ ga Ɵ on O ffi ce of the Inspector General found that Medicare Advantage plans improperly applied Medicare coverage rules to deny 13% of PA requests and 18% of payments, in some cases ignoring prior authoriza Ɵ ons or other documenta Ɵ on necessary to support the payment. Meanwhile, a Kaiser Family Founda Ɵ on analysis found Medicare Advantage plans denied 2 million PA requests in whole or in part, represen Ɵ ng about 6% of the 35 million 2021 requests submi Ʃ ed. Of the 11% of appealed denials, the vast majority (82%) of appealed denials were fully or par Ɵ ally overturned, raising serious concerns about the appropriateness of many of the ini Ɵ al denials. Transparency in medicine - or lack thereof - has become one of the biggest conversa Ɵ ons in healthcare poli Ɵ cs. Over the last decade, non-physician healthcare providers have begun using the “doctor” moniker before their name confusing pa Ɵ ents who are unaware that this is an academic Ɵ tle, not a medical one. You may believe you are being treated by a physician, when if fact you are not. It’s your right to ask who’s trea Ɵ ng you. It’s also your right to ask for a physician if the person providing your care is not one. You are not alone in your “want” for a physician. Transparency in Medicine Is your doctor a PHYSICIAN? Ask! It’s your right to know.
The 2021 Pa Ɵ ent Survey conducted by the AMA shows that Pa Ɵ ents Prefer Physician-Led Care
In poli Ɵ cal circles, the term is Scope of Prac Ɵ ce . Scope of prac Ɵ ce refers to those ac Ɵ vi Ɵ es that a person licensed to prac Ɵ ce as a health professional is permi Ʃ ed to perform, which is increasingly determined by statutes enacted by state legislatures and by rules adopted by the appropriate licensing en Ɵ ty. Laws, de fi ni Ɵ ons and regula Ɵ ons on scope of prac Ɵ ce within health care professions vary from state to state. In Louisiana, advanced prac Ɵ ce registered nurses and physician assistants must work with a licensed physician, MD or DO. Physicians believe that every health care professional has an important role to play in caring for pa Ɵ ents, but the high-stakes fi eld of medicine demands the educa Ɵ on, experience and acumen of a fully trained physician. This is why the LSMS stands in strong support of physician- led health care teams. As part of a physician-led care team, nonphysician health care professionals can and do provide safe and essen Ɵ al health care to pa Ɵ ents. The health and safety of pa Ɵ ents like you are threatened, however, when nonphysician health care professionals are permi Ʃ ed to perform services that are beyond the boundaries of what they have been educated and clinically trained to do. For the last 15 years, non-physician healthcare professionals have used the legisla Ɵ ve process to try to push forth an agenda that allows them to get by legisla Ɵ on what they did not earn through educa Ɵ on. Nonphysician skillsets are not interchangeable with that of fully trained physicians! In fact, most nonphysician healthcare providers require on-the-job training from a physician a Ō er they graduate from their chosen program.
The di ff erence is real… The number of hands on clinical training hours required by medical educa Ɵ on versus nonphysician educa Ɵ on is truly extreme as shown in the graph. Let’s look at more numbers. They show what you as a pa Ɵ ent are concerned about: 1. Quality of your care. 2. Cost of your care.
The studies are star Ɵ ng to show what physicians and pa Ɵ ents have known… One of the leading accountable care organiza Ɵ on says pa Ɵ ents with a non-physician primary care provider had $43 higher costs per member per month when compared to those who had a physician. This could translate to $10.3 Million more in annual spending.
