The information provided in the Safety Data Sheets (SDS) is correct to the best of our knowledge, information and belief as of the date of its publication and is designed only as guid- ance for safe handling, use, processing and storage of the Product. This SDS relates only to the specific materials and product (“Product”) designated in this SDS and may not be valid for other materials or such material used in combination with any other materials or in any process, unless expressly stated herein. HAI’s current General Terms and Conditions of Sale apply to all sales of HAI’s Products which terms and conditions may be located at HAI’s website. No warranty is ex- pressed or implied as to the accuracy, completeness or adequacy of this information, the results to be obtained from the use thereof or the hazards connected with the use of the Product. EXCEPT THAT THE PRODUCT SHALL MEET WRITTEN AGREED UPON SPECIFICATIONS, HAI HEREBY DISCLAIMS AND MAKES NO WARRANTIES, WHETHER EXPRESS, IMPLIED BY OPERATION OF LAW OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES FOR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AS TO ANY CONDITION, QUALITY, SAFETY OR PERFORMANCE OF THE PRODUCT, AND AS TO TRADE USAGE OR DEALING. HAI cannot anticipate all conditions under which this information and Product, or the products of other manufacturers in combination with this Product, may be used. Determination of the suitabil- ity of the Product for the uses and application contemplated by the Buyer, user and others shall be the sole responsibility of the Buyer and users of the Product. Buyer acknowledges the hazards associated with the handling, unloading, discharge, storage, transportation, use, disposition, pro- cessing, admixture, or reaction (the “Use”) of Product supplied under applicable Purchase Order or Agreement and assumes the responsibility of advising those of its employees, agents, contrac- tors, and customers who will use, work or come in contact with Product of the hazards to human health or human or environmental safety, whether such Product is used singly or in combination with other substances or in any processes or otherwise and for the Use of such Product. If Buyer believes or has reason to believe the SDS or other information provided to Buyer by HAI is inac- curate or in any way insufficient for any purpose, Buyer will immediately notify HAI of the same, and provide HAI a reasonable opportunity to supplement or correct the information. Failure of Buyer to timely provide such notice shall be deemed a waiver by Buyer of any and all claims, demands or causes of action for personal injury, damage to the environment or property arising from or attributable to the Use of Product.
