TEACHERS ARE NOT EXEMPT FROM AGENCY WORKERS REGULATIONS

20 October 2011 Government officials from the Department for Education (DfE) have confirmed that ‘teachers are not exempt from the Agency Workers Regulations under regulation 3(2).’ Recruitment Consultant reported the following: The government statement was issued after being prompted by concerns raised by Randstad UK and in subsequent discussions with the DfE, after widespread confusion amid what has been described by some senior HR professionals as ‘a campaign of deliberate misinformation by some agencies.’ Randstad Education’s Stewart McCoy, explained: ‘I have been in dialogue with the DfE since September when some agencies were suggesting that teachers are professionals, and therefore out of scope. It’s a clear cut answer which I welcome from the DfE as a result of Randstad highlighting the issue.” The government ended its statement by thanking Randstad for drawing the DfE’s attention to the issue and promised to ‘update the guidance on our website to confirm the position’. 29 November 2011 The statement delivered by the chancellor today held no bombshells and was mainly to do with the UK debt issue and re-igniting growth in business; however there were some items of interest for payroll. The Policy team had hoped to produce a webcast for members but didn’t feel there was enough relevant content to justify one. Public Sector Pay The two year pay freeze will be coming to an end next spring for some of the public sector and for most it will be during 2013. The government will set public sector pay awards at an average of 1% for each of the two years after the pay freeze ends. Also announced is that the government are asking the independent Pay Review Bodies to consider how public sector pay can be made more responsive to local labour markets and they will be asked to report back by July next year. Departmental budgets will be adjusted in line with the pay rises with the exception of the health and schools budgets, where the money saved will be recycled.
