THE EQUALITY ACT CODES OF PRACTICE

6 April 2011 The Equality and Human Rights Commission (TEHRC) has published a number of codes of practice for The Equality Act that comes into force from 6 April 2011. According to their press release they say; “This is the most significant piece of equality legislation for many years. It simplifies streamlines and strengthens the law. It gives individuals greater protection from unfair discrimination and makes it easier for employers and companies to understand their responsibilities. It also sets a new standard for those who provide public services to treat everyone, with dignity and respect. In line with our statutory powers, we have produced Codes of Practice on employment; services, public functions and associations; and equal pay. The purpose of these Codes of Practice is to explain the new statutory provisions of the Equality Act. The Codes will help to ensure that the law is applied consistently by lower courts and tribunals. They will also help make the law accessible to a wider audience, such as those who have obligations and those who have rights - or their representatives. The Codes set out clearly and precisely what the legislation means. They draw on precedent and case law and explain the implications of every clause in technical terms. These statutory codes are the authoritative source of advice for anyone who wants a rigorous analysis of the legislation's detail. For lawyers, advocates and human resources experts in particular, they will be invaluable.” 11 May 2011 The Government Equalities Office has issued a replacement quick start guide on the public sector equality duty. This replaces previous guidance on the public sector Equality Duty published by the Government Equalities Office on 12 January 2011. Please discard the previous guidance. This quick start guide is intended to help public sector organisations understand a key measure in the Act – the public sector Equality Duty, which came into force on 5 April 2011. The Equality Act 2010 (the Act) replaces the previous anti-discrimination laws with a single Act. It simplifies the law, removing inconsistencies and making it easier for people to understand and comply with it. It also strengthens the law in important ways, to help tackle discrimination and inequality. The majority of the Act came into force on 1 October 2010. PUBLIC SECTOR EQUALITY DUTY
