On September 24, 2024, the Vietnamese government issued the first draft of a new Law on Personal Data Protection (PDPL). The draft law, scheduled to take effect on January 1, 2026, forms part of moves to build a robust framework for personal data protection. The Draft PDPL - more comprehensive than 2023’s Decree No. 13/2023/ND-CP on Personal Data Protection (PDPD) - covers a wide range of areas, including marketing services, behavioural advertising, big data processing, AI, cloud computing, employee monitoring and recruitment, financial and credit data, healthcare and insurance. Vietnam Briefing provides a closer look at the draft PDPL’s key provisions and the challenges and compliance considerations ahead.
