EMPLOYER FLOUTING NMW RULES IS NAMED

Norman Lamb, Minister for Employment Relations, has named an employer under the BIS Scheme for naming employers who flout National Minimum Wage (NMW) law.

Leicester based hair and beauty salon owner, Mrs Rita Patel trading as Treena Professional Hair & Beauty, neglected to pay £3,361.22 in arrears of the NMW to a former worker following an investigation by HM Revenue and Customs (HMRC), which has resulted in HMRC enforcing the debt through the court. HMRC’s investigation showed that over a period of four-and-a-half months, Mrs Rita Patel paid only £342.00 to a worker in her hair and beauty salon. Under the NMW Act the worker was in fact legally entitled to £3,703.22 for work undertaken during that period.

NATIONAL MINIMUM WAGE FROM OCTOBER 2012

The Department for Business, Innovation and Skills has announced that the rates of national minimum wage applicable to pay reference periods starting on or after 1 October 2012 will be as follows:  the main adult rate (for workers 21 and over) will increase by 11p to £6.19 an hour (currently £6.08 an hour)  the rate for 18-20 year olds will remain at £4.98 an hour  the rate for 16-17 year olds will remain at £3.68 an hour  the rate for apprentices will increase by 5p to £2.65 an hour (currently £2.60 an hour).

From the same date, the daily accommodation offset rate will increase from the current £4.73 to £4.82.

BIS – NATIONAL MINIMUM WAGE COMPLIANCE & ENFORCEMENT

The Department for Business Innovation & Skills (BIS) have published a report which spans an 18 month period and reports on compliance & enforcement activity carried out to ensure increased employer compliance with payment of the National Minimum Wage (NMW).
