Again opinion was split, despite a wide range of views two themes emerged: some respondents felt it should attract the same penalty as any other FPS and others suggested a similar penalty to the current end of year regime. Unsurprisingly there was overwhelming, though not unanimous agreement to the suggestion of a temporary tolerance for discrepancies. The most common specific amount suggested was £100, but many suggested a percentage of the discrepancy ranging from 0.5% to 10%.

As members will know the CIPP has, along with other stakeholders been working with HMRC to request they consider some concessions for those payroll situations where we just cannot submit an FPS at the time of payment. The wait has been worth it, as HMRC will be allowing some concessions for certain situations. These include: Ad-hoc payments outside the normal payroll cycle, and not a regular occurrence; The treatment of loans, e.g. where an employer has a new starter, but they have missed the payroll the employer might give the employee a loan until the next pay day. Please note if you give an advance of salary i.e. not a loan and this is for earnings on account PAYE is due and so will an FPS be due! Payments in cash such as those made for fruit pickers who get paid by the quantity of fruit in cash; Payments that are subject only to Class 1 NICs e.g. a BiK; Notional payments such as those made in respect of share schemes.
