The government have considered the responses to the consultation carefully, and intend to proceed with the proposal. This will mean that an employment tribunal which finds that an employer has discriminated on grounds of sex in contractual or non-contractual pay will be obliged to order the employer to conduct a pay audit in cases where continuing discrimination is likely. An audit would not be ordered if an audit has been completed in the last three years, the employer has transparent pay practices or the employer can show a good reason why it would not be useful. Micro businesses will initially be exempt from the proposals. The government intends to issue a further consultation later this year on the exact details of how the audits will operate and what publication requirements will apply. They will work closely with business organisations and other interested stakeholders throughout this process, and will seek an opportunity to bring forward legislation when Parliamentary time allows. This proposal will supplement “ Think, Act, Report ”, which is a simple, voluntary, step-by-step framework to help companies think about gender equality in their workforces, on key issues like recruitment, retention, promotion, and pay.

FLEXIBLE PARENTAL LEAVE

The Telegraph has reported news about the introduction of shared parental leave, the details of which were included in the Modern Workplaces consultation published in July 2011. The CIPP Policy team has been waiting with interest for a formal response to this consultation as it has been delayed for some months now due to on-going discussion within government. According to the Telegraph we are due to hear from the Prime Minister and his deputy during the last week in October when they will announce the scheme formally as part of a series of initiatives intended to demonstrate that the Coalition parties are working well together. The Telegraph’s report seems to have merged the Additional Statutory Paternity Pay (ASPP) rules (introduced in 2011) in with the proposals for the new system of flexible parental leave. This is not wholly surprising as the new system plans to build on ASPP. Further to Nick Clegg’s announcement yesterday, the government has published their response to the flexible parental leave and flexible working elements of the Modern Workplaces consultation .
